All funding decisions are made at our sole discretion based on our underwriting criteria. Submission of an application does not guarantee approval or funding.

Application and Underwriting

Information Accuracy

You agree to provide accurate, complete, and current information in all applications and communications with us. Providing false, misleading, or incomplete information may result in:

• Denial of your application
• Termination of existing funding arrangements
• Legal action for fraud or misrepresentation

Credit Authorization

By submitting an application, you authorize RCA GROUP INC to:

• Obtain credit reports and scores from credit bureaus
• Verify information with third parties, including banks and trade references
• Review financial statements, tax returns, and other documentation
• Conduct background checks as permitted by law

Approval and Funding

Funding approvals are subject to satisfactory completion of due diligence, verification of information, and execution of formal lending agreements. We reserve the right to:

• Deny any application for any reason
• Modify terms and conditions based on our risk assessment
• Rescind approvals if material information changes
• Require additional documentation or collateral

Repayment and Default

Payment Obligations

Borrowers agree to repay all amounts borrowed according to the terms specified in their funding agreement. Payment terms may include:

• Fixed monthly payments
• Percentage-based repayments tied to revenue
• ACH debits from designated bank accounts
• Other structures as mutually agreed

Default and Remedies

Default occurs when a borrower fails to meet payment obligations or violates any term of the funding agreement. In the event of default, we reserve the right to:

• Accelerate the outstanding balance
• Initiate collection proceedings
• Report delinquencies to credit bureaus
• Pursue legal remedies, including filing suit and obtaining judgments
• Apply security interests or enforce collateral agreements

SMS Terms & Conditions

If you provide express written consent to receive text messages (SMS/MMS) from RCA GROUP INC, the following terms apply:

Consent and Purpose

By opting in, you agree to receive recurring marketing and promotional text messages from RCA GROUP INC using an automated telephone dialing system (ATDS). Messages may include information about our financial products, services, offers, and updates.

Message Frequency

Message frequency varies based on your account activity and promotional campaigns. You may receive up to 4 messages per month.

Message and Data Rates

Message and data rates may apply based on your mobile carrier's plan. Check with your carrier for details about your messaging plan and potential charges.

Opt-Out Instructions

You may opt out of receiving text messages at any time by replying STOP to any message from us. Upon receiving your STOP request, we will send one final confirmation message and cease sending further messages to that number.

Consent Not Required for Services

We are not liable for delayed or undelivered messages due to issues with your mobile carrier or device. Supported carriers include major U.S. wireless providers; check with your carrier for compatibility.

Intellectual Property

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through:
